Welcome to the Dokterme mobile application (the "App"). The App provides services that allow doctors to manage patient appointments, communicate with patients, and access patient records (the “Services”).

The App is owned and operated by CV. Dokternet (“we,” “us,” or “our”). By downloading, accessing or using the App or any of the Services, you agree to be bound by these Terms of Use and any amendments made to them from time to time. If you do not agree to these Terms, do not download, access or use the App or Services.

Using the App and Services

You may use the App and Services only if you are a licensed medical professional or someone authorized by a licensed medical professional to make appointments and access patient information on their behalf.

To use the Services, you must register for an account by providing your name, medical license information, contact information and other details required during registration. You agree to provide true and accurate information when registering for an App account and to keep your account information updated.

We reserve the right to suspend or terminate your account if any information provided during registration or thereafter proves to be inaccurate, fraudulent or misleading.

You are responsible for maintaining the confidentiality of your account username and password. You agree not to share your log-in credentials with any third party. You agree to immediately notify us of any unauthorized use of your account.

Use Restrictions

You agree not to use the App or Services:

• For any illegal, fraudulent, improper or harmful purpose
• To transmit malware, spam, phishing attempts or other unsolicited messages
• To infringe on intellectual property rights of others
• To access or use the accounts of other users without authorization
• To interfere with the operation of the App and Services

We reserve the right to terminate accounts or block access to users who violate these use restrictions.

Patient Information

The App and Services allow you to access protected health information of your patients. You agree to access, use and disclose this information only as necessary for treatment, payment and healthcare operations purposes, consistent with applicable law.

You agree not to share patient information with any third parties, except with the express consent of the patient or as required by law. You are solely responsible for ensuring you comply with all applicable laws relating to the privacy and security of patient medical records.

Intellectual Property Rights

The App and Services, including all content, software and source code, are the intellectual property of CV. Dokternet. All rights in and to the App and Services are reserved. Using the App and Services does not grant you ownership of any intellectual property rights.

You may not modify, adapt, translate, reverse engineer, decompile or disassemble the App or Services or create derivative works based on the App or Services.

User Content

You are responsible for all text, information, graphics, audio, videos and other content you upload or transmit through the App and Services ("User Content"). You will retain ownership of your User Content.

However, by uploading or transmitting User Content through the App and Services, you grant us a worldwide, perpetual, irrevocable, transferrable license to use, copy, modify, distribute, create derivative works of, publicly display, publicly perform and sublicense your User Content in connection with operating and providing the App and Services.

You represent and warrant you have all rights necessary to grant us the license to User Content as described above.

Liability Disclaimer

The App and Services are provided "as is" without warranty of any kind. We disclaim all express, implied and statutory warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.

We are not liable for any loss, corruption or damage to your data transmitted over our network or stored on our servers. You are solely responsible for maintaining independent backup copies of your data.

We are not liable for any defamatory, offensive, illegal or unlawful User Content you may encounter using the App or Services. Your use of the App and Services is at your own risk.

Indemnification

You agree to indemnify and hold harmless CV. Dokternet, its officers, directors, employees and agents, from and against any claims, actions, proceedings, losses or damages, including reasonable attorneys’ fees, arising out of your use of the App or Services, violation of these Terms, violation of applicable laws, or infringement of any third party rights.

Limitation of Liability

CV. Dokternet will not be liable to you for any lost profits or consequential, special, punitive, indirect or incidental damages arising out of or in connection with the App or Services, even if we have been advised of the possibility of such damages.

In no event will our aggregate liability arising out of or relating to the App or Services exceed the greater of $100 or the fees actually paid by you for use of the App and Services during the past six months.

Governing Law

These Terms are governed by the laws of [Your State] without regard to conflict of law principles. Any dispute between you and us regarding these Terms or the App/Services will be subject to the exclusive jurisdiction of the state and federal courts located in [Your State].

Termination

We reserve the right to terminate your access to the App and Services, without notice, for any actual or suspected violation of these Terms or abuse of the Services.

Upon termination, your right to access or use the App and Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive termination.

These Terms constitute the entire agreement between you and us with respect to the subject matter hereof and supersede any prior or contemporaneous communications.
